We have an exciting opportunity to join our team as an Associate General Counsel (Claims Administration and Litigation Management).
Under the direction of the VP & Senior Associate General Counsel for Claims Administration and Litigation Management, the primary responsibility of this role is to provide competent, timely and proactive legal advice in the daily handling and management of medical malpractice cases and claims, which are insured under the NYU Langone Hospitals Malpractice Insurance Program. The primary client is the Sr. Vice President in charge of the Insurance Program. This role will directly manage and direct the day to day activities of the assigned claim files and outside counsel by proactively coordinating the most reasonable and strategic defenses to optimize claim handling and results. There is a heavy emphasis on the successful direct management and negotiation of litigated and prelitigation claims with a successful case closure target number.
Under the direction of the VP & Senior Associate General Counsel for Claims Administration and Litigation Management, the Associate General Counsel will be working closely with the Sr. Vice President in charge of the Insurance Program, the Insurance Department, outside Third Party Administrator and Risk Management, and will have the following responsibilities:
Assume primary responsibility for the legal management and resolution of approximately 40+ high value claims assigned in various state and federal jurisdictions.
Assist in choice of counsel.
Manage and direct outside counsel along with resulting litigation costs.
Keep Sr. Vice President, VP & Senior Associate General Counsel for Claims Administration and Litigation Management and Director of Malpractice Insurance Program informed of material claims and status of litigation.
Initiate early resolution of claims via direct strategic negotiation when appropriate; encourage mediation and other forms of dispute resolution and judicial intervention, where appropriate.
Negotiate cases directly with adversaries.
Stay up-to-date on changes in law and legal climate.
Provide legal analysis and positions on coverage issues.
Provide day-to-day strategic planning on claims handling.
Provide timely responses to time sensitive projects, as assigned.
Attend and travel to all phases of Court conferences and trials for each case, as needed.
Manage, attend and direct, as necessary, the preparation of key defendants for deposition.
Determine, with defense counsel, trial strategies.
Monitor all phases of trials, reporting to relevant NYULH parties daily progress and modify strategies as developments dictate.
Manage, attend and direct, as necessary, the preparation of key defendants for trial.
Participate and present at claims conferences; lead roundtable discussions and committee reviews; present case summaries, as needed.
Prepare Executive Claims Summary for each case being handled with timely reserve setting recommendations.
Keep claims professionals up to date on emerging issues relating to coverage and litigation.
Review and manage pleadings, motions, briefs, appellate papers, etc., as needed, to proactively defend and strategically manage litigation.
Perform other related duties, as assigned.
Admission to the NY Bar with at least 10 years experience in broad-based medical malpractice, which must include experience in insurance law, coverage issues and disputes, and NY litigation.
Significant direct negotiation skills and aptitude.
Effective oral and written communication skills with the ability to present case reviews and recommendations, work collegially with diverse personnel and under the direction of the VP.
Maintain NY bar admission in good standing for the duration of the position.
Qualified candidates must be able to effectively communicate with all levels of the organization.
