This role is to act as a trusted advisor, with responsibility for oversight and support of multiple functions, providing valuable conduct and regulatory advice to enable the business to meet its regulatory requirements and provide positive outcomes.
The Compliance & Conduct function is responsible for the independent oversight of core processes, related policies and procedures that seek to ensure conformity with industry-specific laws and regulations, thereby helping to deliver good customer outcomes and maintain the bank's reputation. This covers, but is not limited to, the following: * Provision of conduct and regulatory advisory services relating to products and bespoke transactions. * Interpretation of product specific legislation, regulation and bank wide policies. * Pro-actively identify potential or actual conduct risks and ensure appropriate mitigation to manage the risks back within appetite. * Membership of key fora, risk and governance committees
* Provide subject matter expertise, 2nd line oversight and challenge of regulatory requirements, ensuring submissions to our regulators are accurate, timely and in full compliance with regulatory requirements. * Review and assess aligned business processes and provide conduct advice through a focus on customer outcomes and where improvements can be made to encourage higher standards and risk reduction. * Provide expert input and guidance on regulatory policy and conduct risk to aligned business area. * Responsible for ensuring read across of industry/cross divisional risks to mitigate potential financial loss and/or reputational damage. * Provision of regulatory advice and analysis in relation to the full product life cycle from product design to post-sales review, business initiatives, bespoke projects, transactions and investigations. * Provide timely regulatory advice to ensure compliance with all relevant laws and regulations and support the transition to proactive and pre-emptive conduct risk mitigation. * Proactively identify potential or actual conduct risks and ensure appropriate escalation, remediation and mitigation to manage risks back to within appetite and ensure remediation activities address root cause. * Develop effective and sustainable working relationships across the bank and Industry.
* Experience in a supervisory role with specific experience of managing conduct risk. * Robust understanding of conduct regulatory frameworks. * Demonstrate appreciation of positive customer outcomes and ability to articulate regulatory requirements in a way that is meaningful to the business. * Ability to manage and influence business stakeholders in relation to conduct across all areas of the business. * Track record of achievement and delivery and previous business / operational experience. * Excellent communication, interpersonal, influencing, team working and collaborative skills. * Ability to work to tight deadlines and ability and flexibility to ensure focus of conduct risk activities is kept relevant and appropriate. * Ability to demonstrate decisiveness and sound judgement on a consistent basis. * Familiar with the Trade & Transaction Reporting regulatory regimes including knowledge of expected controls required to demonstrate that firms are reporting completely, accurately and on time. * A clear understanding of the rules relating to EMIR and MiFID reporting and how they relate to a financial counterparty or Investment Firm including knowledge of what financial instruments are reportable under each jurisdiction * Familiar with EMIR Risk Mitigation such as Clearing and Margin requirements
* Knowledge and experience of providing regulatory and technical support and advice to senior management. Particularly in relation to EMIR, MiFID, MiFID 2 and SFTR. * Deep understanding of conduct risk management principles. * Understanding of how regulatory, political, reputational and environmental issues impact the business (including commercially.)
Risk Management: * Support a consistent and effective approach to conduct and regulatory risk assessment. * Manage conduct risk to meet the bank's Conduct Risk Appetite, the expectations of our regulators and support the delivery of good customer outcomes. * To ensure the importance and effective management of conduct and regulatory risk is recognised and understood. * Promote appropriate levels of bank-wide conduct standards. * Operate with skill, care and diligence and demonstrate the highest ethical standards at all times. * Concerns are escalated in a timely manner where there is non compliance with regulations and/or Policy. * Consistently demonstrate the required behaviours, positive attitude and professionalism in all dealings with internal and external stakeholders. * Proactively seek areas of improvement and simplification of legacy processes and procedures.
