Departmental Overview The Office for the Prevention of Harassment and Discrimination (OPHD) is responsible for ensuring the University provides an environment for students, faculty and staff that is free from discrimination and harassment on the basis of categories including race, color national origin, gender, age and sexual orientation/identity. OPHD has the specific responsibility for implementing compliance programs related to discrimination and harassment on the basis of protected categories, including sexual violence and sexual harassment, as well as oversight of other campus program activities located outside of OPHD's immediate office, e.g., mandatory SVSH prevention education and Title IX Athletics compliance.
Responsibilities Provides leadership, management and highest-level technical expertise in the resolution and remediation of protected category discrimination and harassment as defined in UC and campus policies; oversees the compliance content development and delivery of required anti-discrimination and sexual harassment/sexual violence prevention education; and assists the Title IX Officer and OPHD Director in liaison responsibilities related to state and federal enforcement agency compliance audits and investigations.
Develops and manages the procedures and protocols for UC Berkeley's institutional response to complaints of discrimination and harassment. Co-chairs the campus-wide Sexual Misconduct Case Management Team, and chairs the Complaint Response Work Group of the Coordinated Community Review Team (CCRT). Oversees the quality and consistency of OPHD investigations and other complaint resolutions. Manages the workflow of the investigation team. Provides expert guidance to investigators, assigns cases to investigators, monitors caseload and identifies best practices to improve efficiency and effectiveness, and ensures consistency, quality, timeliness, and trauma-centered approach of OPHD's complaint resolution operations. Responsible for the continuous improvement of complaint resolution protocols and standards. Identifies and proposes resource solutions when problems arise.
Leads the most complex and/or sensitive investigations of discrimination and harassment. Serves as a strategist to the OPHD Director in identifying systemic risks associated with campus response systems for sexual harassment and violence complaints. Proposes solutions to the identified problems.
Provides regular updates on complaint resolution activity and other performance metrics to the OPHD Director, and signs off on submissions of complaint resolution metrics to the UC Office of the President. Collaborates on OPHD briefings to campus leaders, externally facing annual reports, and responses to data requests from government enforcement agencies, media outlets and legal advocates.
Five years of progressive experience working in Title IX or other EEO compliance or enforcement, including conducting complex investigations of discrimination allegations
Advanced knowledge of the applicable requirements of federal and state nondiscrimination regulations (e.g., Title IX, Title VI, Title VII, CA FEHA, etc.)
Demonstrated ability to communicate effectively, both verbally and in writing, about compliance and risk issues, as well as sensitive, nuanced issues emerging from complex investigations
Experience advising multiple stakeholders in a large, complex organization with a focus on demonstrated skills in the following areas: - exercising good judgment and critical thinking in decision-making and problem solving - employing skills active listening and facilitating difficult conversations with diverging points of view - excellent interpersonal skills that demonstrate the capacity to reach across a wide variety of audiences - preparing and delivering presentations, management briefings, and training curriculum for high level audiences
Bachelor's degree in related area and/or equivalent experience/training
Title IX compliance certification
Comprehensive training in Clery Act and VAWA compliance
Experience in a Title IX compliance or enforcement setting
Professional experience in a higher education context
Training in trauma-informed investigation practices or related experience
